Terms of Service
The rules for using Hetscale, in plain words. By creating an account on app.hetscale.com you agree to them.
Who we are
Hetscale is operated by Ahmet Bora, a sole proprietorship registered in Türkiye (tax office Kartal, tax number 1800321546), Golden Tulips Residence No: 145/29, Kartal/İstanbul, Türkiye. "We" and "us" in these terms mean that business. You reach us at support@hetscale.com.
Hetscale is not affiliated with Hetzner Online GmbH.
What Hetscale does
Hetscale is a control plane for stateless applications on Hetzner Cloud. You connect your own Hetzner project with an API token. Hetscale reads its servers, load balancers and metrics and, once a group is Live, adds servers behind your load balancer when the load rises, removes them when it falls and replaces the ones that fail. Your traffic never passes through Hetscale.
Observe is a 14-day read-only trial and needs no card. Live needs a plan. How each step decides and what it never does is described on How it works andSecurity.
Your account
You sign up with an email address you can receive mail at, or with a GitHub or Google account whose address it has verified. Keep your password, and the GitHub or Google account you sign in with, to yourself: you are responsible for what is done under your account and in your organisation. If you think someone else has used it, write to us at once.
Your Hetzner project
Your Hetzner account and every resource in it stay yours, and you pay Hetzner for them directly, including the servers Hetscale creates for your groups. The limits you set for a group, such as its maximum servers and its cost guard, bound what Hetscale creates; within them, what Hetzner charges for your servers is yours to pay.
Hetscale creates only its own resources: the servers, snapshots and placement groups it makes for your groups, labelled as its own. It deletes only those servers, a seed you promoted to a managed server, an empty placement group of its own, and the snapshots of its own that no release or server needs when you confirm their deletion on the Deployment page. It adds its servers to your load balancer and removes them from it. Anything else it changes only in a step you confirm yourself in the application, such as turning on Hetzner's delete protection or promoting your seed server. Everything else in your project is listed, never touched.
Hetzner's own terms and limits apply to your account: Hetscale cannot create a server Hetzner has no stock for, or one beyond your project's limits.
The API tokens you connect are stored encrypted. Deleting a token in the Hetzner Console stops Hetscale from acting in that project at once.
Plans and payment
The plans, their prices and what each includes are on the pricing page. Prices are in euro and exclude VAT.
Our order process is conducted by our online reseller Paddle.com, the merchant of record for every order: Paddle sells the subscription, takes the payment, adds the VAT of your country and issues the invoices, under its own buyer terms.
A subscription renews at the end of each monthly or yearly period until you cancel it. A change of plan applies at once and is prorated: Paddle charges the difference for the rest of the period, or keeps the unused part as credit for your next payments. Credit is not paid back to your card.
A plan covers a number of servers, and above them your fleet can burst for a number of hours a month, as the pricing page lists. Once the month's burst is spent, you have 7 days to change the plan; after that, new servers above the plan wait until the plan changes or the month ends. After a downgrade below your running fleet, new servers wait until the fleet fits the new plan. Nothing running is removed, and a replacement for a failed server is never held back.
If a payment fails, Paddle tries again. Scaling and healing go on for 14 days after the payment was due; after that Hetscale only observes your groups until a plan applies again. Nothing is removed from your Hetzner projects.
Cancellation and refunds
You can cancel at any time on the billing page, and withdraw the cancellation until it takes effect. The plan runs to the end of the period you paid for, and scaling and healing go on for 14 days after it; then Hetscale only observes your groups. Nothing is removed from your Hetzner projects: servers, snapshots and labels stay where they are, and you delete what you no longer need in the Hetzner Console.
Refunds follow the refund policy.
Acceptable use
Do not use Hetscale to break the law or Hetzner's terms, to attack or overload other systems, or to reach data that is not yours. Do not work around the plans' limits or the Hetzner API budget, and do not resell access to Hetscale without our written agreement. We may suspend an account that does any of this, and we tell you why.
Availability and changes
We run Hetscale with care, but it is provided as it is: we do not promise uninterrupted service, or that capacity is always available. Hetzner can run out of a server type, and a new server receives traffic only after it passes your load balancer's health check. While Hetscale is unreachable, your servers and your load balancer keep running as they are; only scaling and healing wait.
We may change or remove features. We tell you by email at least 30 days before a change to these terms or to your plan's price applies to you, and you can cancel before it does.
Support
Support is by email to support@hetscale.com, also through Contact support and Report a problem in the dashboard. Response times are targets, not guarantees; business days are Monday to Friday. Team's mail is answered first, with a first reply within one business day.
Liability
As far as the law allows, we are not liable for indirect or consequential losses, for lost profits or revenue, or for what Hetzner charges for your account, and our total liability for any claim is limited to what you paid for Hetscale in the 12 months before it arose.
Nothing in these terms limits a liability the law does not allow to be limited, such as for intent or gross negligence, or the rights a consumer has under the law of their country.
Ending the agreement
You can stop using Hetscale at any time; to have your account deleted, write to us. We may end an account that breaches these terms seriously or repeatedly, after telling you why. When an account ends, Hetscale stops acting in your projects, and nothing in them is removed.
How we handle personal data is in the privacy policy. The data about your infrastructure, such as server lists, metrics and events, is yours; we use it only to run Hetscale for you. The data processing agreement is part of these terms and covers the personal data we process for your organisation.
Law and disputes
These terms are governed by the law of the Republic of Türkiye. The courts and enforcement offices of İstanbul (Anadolu) have jurisdiction, unless the law of your country gives you, as a consumer, the right to go to your own courts.
